GP Online User Agreement

1. In these terms and conditions, “You” are the client who has asked Us to provide debt management services to You; and references to “We” or “Us” are to Gregory Pennington Limited, Think Park, Mosley Road, Trafford Park, Manchester, M17 1FQ.

2. This service is an information, internet-based, service (“the Service”) whereby You can view your personal financial details and debt plan arrangements and update your records. The Service is provided to You as part of your existing relationship with Us subject to You agreeing to be bound by this User Agreement (“the Agreement”). By accessing the Service, You are indicating that You have read this Agreement and that You agree to be bound by it.

If you have a complaint

We will issue a username and password to You to access the Service. You are required to keep the password secure and confidential and must not disclose this to any third party. We suggest that You change your password no less frequently than monthly.

1.The works of authorship contained in the Service, including but not limited to all design, text and images, are owned by Us or are used and displayed by Us with permission, and may not be copied, reproduced, transmitted, displayed, performed, distributed, rented, sublicensed, altered, stored for subsequent use or otherwise used in whole or in part in any manner without our prior written consent. You acknowledge and agree that We and/or its licensors own all intellectual property rights in the Service

2.When You post information whilst accessing the Service, You must ensure that the information You provide is full, accurate and not misleading. This information will be relied upon by Us and We will not be responsible for any loss or damage resulting or connected to any anomalies in the information posted by You.

3.You acknowledge that the details shown on the Service may not always be up to date and should not be relied upon without first speaking to Us to confirm the accuracy.

4.Forward-Looking Statements. Some of the information in this Service may contain predictions, projections or other forward-looking statements regarding future events or the future performance of your debt plan. Such statements are only predictions and those actual events or results may differ materially.

You acknowledge that as the Service is accessed via a secure website, We cannot guarantee that your use will be uninterrupted or error-free; nor that the Services and/or the information obtained by the Creditor through the Services will meet your requirements or be fully up to date and accurate. We are not responsible for any delays, delivery failures, or any other loss or damage resulting from the transfer of data over communications networks and facilities, including the internet, and You acknowledge that the Services may be subject to limitations, delays and other problems inherent in the use of such communications facilities.

1.You agree not to access, store, distribute or transmit any virus or any material that facilitates illegal activity or is harmful, threatening or defamatory during the course of the Service. We do not guarantee that the Service will be free from viruses and are not responsible for damage caused by viruses or similar defects. The Service is used by You at your own risk and You are advised to use appropriate anti-virus software.

THE SERVICE, INCLUDING WITHOUT LIMITATION ALL CONTENT AND INFORMATION MADE AVAILABLE ON OR ACCESSED THROUGH THE SERVICE, IS PROVIDED "AS IS" WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WITH RESPECT TO NON-INFRINGEMENT, TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

3.Disclaimers of Warranty. THE SERVICE, INCLUDING WITHOUT LIMITATION ALL CONTENT AND INFORMATION MADE AVAILABLE ON OR ACCESSED THROUGH THE SERVICE, IS PROVIDED "AS IS" WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WITH RESPECT TO NON-INFRINGEMENT, TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Notwithstanding any other provision of these terms and conditions, We will be liable to You without limit for any death or personal injury caused by our negligence and to the extent that liability arises under Part 1 or section 41 of the Consumer Protection Act 1987 and for liability arising from statements made fraudulently by Us.

1.Changes. We reserve the right to add to, change, move or delete any part of this Service and this Agreement from time to time without prior notice to You.

2.The Service is only available whilst You are actively receiving advice from Us and We reserve the right to suspend or terminate your access to the Service immediately without notice at any time.

3.Personal Information. We shall comply with all applicable Data Protection laws in the UK. You agree to Us processing your personal data in connection with the Service. For a description of how We will use your personal data, please see our Data Protection Statement.

4.Assignment. You may not transfer any of your rights or delegate any of your obligations under these terms and conditions without our prior written consent.

5.Failure to enforce. If We fail to enforce any provision of this Agreement, that failure will not prevent Us from enforcing either that provision (or any similar provision) on a later occasion.

6.General. Nothing in this Agreement affects your statutory rights as a consumer. This Agreement is governed by English law and any dispute connected with them is subject to the exclusive jurisdiction of the English courts.

7.Complaints. Please tell us if You are dissatisfied with the Service or any aspect of it. You can contact Us by telephone or post. Our complaints procedure sets out how to complain and how We will deal with your complaint to try to resolve it.
